Kota Kinabalu: A 39-year-old man, was sentenced to death by the High Court here for trafficking 1,746.8gm of syabu five years ago.
Ang Eng Khong was found guilty of committing the offence at 4.30pm on Oct 31, 2018, at Taman Awam Teluk Likas, here.
High Court Judicial Commissioner Amelati Parnell in convicting Ang, held that the court found the prosecution had successfully proven its case beyond reasonable doubt.
Ang was the sole defence witness and gave his evidence under oath.
The prosecution had called nine witnesses to testify at the prosecution’s stage.
Ang had on Jan 20, 2020 claimed trial to the charge under Section 39B(1)(a) of the Dangerous Drugs Act.
The charge carries the death sentence or imprisonment for life and whipping not less than 15 strokes if not sentenced to death, on conviction.
Deputy Public Prosecutor (DPP) Azreen Yas Mohamad Ramli prosecuted while Ang was represented by counsel Luke Ressa Balang and Dominic Chew.
In another similar case, a 29-year-old man, who allegedly trafficked 2,129.1gm of syabu will know his fate on May 10.
Amelati fixed the decision date when Anthony Chan Wei Onn closed his defence after testifying as sole defence witness.
Chan, an air-conditioner repairman, gave evidence under oath.
He was accused of trafficking the drugs at 6.20pm on July 12, 2019 at the J&T Express premises on the ground floor, Kolam Plaza Phase 1, Jalan Lintas.
Chan had on Jan 20, 2020 claimed trial to the charge.
He was ordered to be remanded further pending the date as the charge against him has no provision for bail.
DPP Tengku Najiha Tengku Zahari of the Customs Department prosecuted while Chan was represented by counsel Kimberly Ye and Chen Wen Jye.
