
Kota Kinabalu: Three men were fined a total of RM4,500 by the Magistrate’s Court, here, Friday, for assaulting a man in Penampang two weeks ago.
Trader Sahrul Nizam Ibrahim, 44, hairstylist Razali Jubri, 37, and mechanic Md Riduwan Abdul Haling, 25, pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to Md Pirdaus Ramas, 23, at 3.40am on Oct 8 at the Hot Kitchen Café and Bar.
They were fined RM1,500 or four months jail each.
The trio were jointly charged under Section 323 of the Penal Code which carries a jail term of up to a year or fine of up to RM2,000 or both, on conviction.
The court was informed by the prosecution that before the incident, the complainant went to the premises to find his friend when he was shoved out by an unknown man.
A few minutes later, a man came and punched the complainant’s left cheek before another two men attacked him, causing him to suffer injuries on his nose and head.
Duty counsel Lim Ming Zoong @ Lawrence, who represented Sahrul and Riduan and duty counsel Carmen Khoo who represented Razali, requested leniency as it was their first offence.
Meanwhile, Sahrul was also facing another charge of committing mischief.
Sahrul pleaded not guilty to damaging tables, chairs, sound system, two units of television and an air conditioner belonging to Rayner Robert, at Aramai Frienz, Kepayan Point, Penampang Bypass, at 2.20am on Sept 9.
The accused allegedly committed the offence under Section 427 of the Penal Code, along with several accomplices.
Inspector Kelvan Elson Maik, prosecuting, in applying for case management proposed bail at RM4,000 in two sureties.
Sahrul was offered bail at RM1,700 in two sureties pending mention of the case on Nov 30.
In another case, a 30-year-old cashier, who fraudulently had RM6,000 deposited into her bank account last year was fined RM100 or three weeks in jail.
Eco Mirfannya admitted to having the money belonging to one Adela Wong in her Public Bank account, in which she failed to give a satisfactory explanation on how she obtained them at 1.37pm on Aug 8, 2022.
The offence under Section 22A (1) of the Minor Offences Ordinance, provides a fine of up to RM100 or up to three months jail or both, on conviction.
