
Kota Kinabalu: An unemployed man was jailed 10 months by the Magistrate’s Court here Tuesday for burglary.
Moses Daud, 39, pleaded guilty before Magistrate Dzul Elmy Yunus to breaking into the Samudera Timur workshop, at Lorong Langsat 1, Inanam, on Feb 17, this year, at 4.45am, with intention to steal.
Moses, whose case came up for pre-trial case management on Tuesday, changed his plea to guilty to the charge under Section 457 of the Penal Code.
Prosecuting Officer, Inspector Mohamad Hamidi Mohamad Hamzah, presenting the facts of the case, informed the court that the workshop owner had observed a man climbing over the fence of his premises via CCTV footage on his mobile phone and immediately alerted his friend, who lived nearby.
Upon the complainant’s arrival, he saw a man, later identified as Moses, carrying several vehicle components from the workshop.
The complainant and his friend apprehended Moses and handed him over to the police.
Counsel Jagnesh Jaya, representing Moses, requested a lower sentence from the date of his arrest, citing that Moses is a divorcee with two school-age children who are now under his care as their mother had abandoned them.
Jagnesh also said that Moses had been employed as a general worker prior to his arrest but is now unemployed.
Hamidi applied for a deterrent sentence.
The magistrate ordered Moses to serve the sentence from the date of his arrest.
Meanwhile, five people were penalised for committing drug-related offences.
Anuar Abdul, Darlanne Augustine, Tonny Gidong and Labihari Tawari pleaded guilty to having syabu weighing between 3.09gm and 0.04gm at separate locations here and in Penampang between Nov 23, 2024 and Jan 20 this year.
Anuar was jailed 12 months jail, Darlanne was handed eight months’ jail, while Tonny and Labihari received six months jail each.
Basir was fined RM1,700 or jailed six months.
They were charged under Section 12 (2) of the Dangerous Drug Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
Meanwhile, Darlanne and Tonny were jailed five months each for taking syabu.
The offence under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years’ jail, on conviction.
