
After an extensive legal battle, an unemployed man narrowly avoided a life sentence as the Federal Court commuted his punishment to 30 years in prison. The case involved the abduction of three Bangladeshi men in 2014, where the perpetrators demanded a ransom of RM50,000.
Led by Court of Appeal president Tan Sri Abang Iskandar Abang Hashim, a three-judge panel unanimously decided to replace the life sentence with 30 years of imprisonment for Suhaimi Alias, aged 47. Additionally, they upheld the previous ruling of 10 strokes of the cane.
The appellant, Suhaimi Alias, had been initially sentenced to life imprisonment and caning by the Shah Alam High Court. However, his legal team continued to appeal the decision. Despite the reduction in sentence, the Federal Court maintained Suhaimi's conviction, ruling that his appeal lacked merit.
The abduction took place at a mini-market in Jalan Meru, Klang, where Suhaimi, along with two others, kidnapped Md Gholam Faruque, Mohamed Rafik, and Sojib. The victims were subsequently locked in a hotel room, prompting a police rescue operation. The prosecution argued that the kidnapping was substantiated by witness testimonies and the victims' ordeal.
During the appeal process, Suhaimi's lawyer argued that the prosecution failed to prove the kidnapping charge as required by the Kidnapping Act 1961. However, the prosecution countered by citing witness testimonies, including one victim who overheard ransom negotiations amounting to RM50,000.
Despite the defense's arguments, the court found sufficient evidence to support the conviction. Consequently, Suhaimi Alias will serve his prison term starting from his arrest date in March 2014.
This case highlights the complexities of criminal law and the meticulous examination of evidence required in legal proceedings. While Suhaimi Alias may have avoided a life sentence, the verdict serves as a stern reminder of the serious consequences of criminal actions.
