
Kota Kinabalu: A company was fined a total of RM15,000 for having unregistered Lianhua Qingwen Jiaonang, unregistered hand sanitisers and cosmetics without notifications.
Sessions Court Judge Noor Hafizah Mohd Salim handed the sentence to C-Care Enterprise Sdn Bhd after its Branch Manager pleaded guilty to the five counts.
The court ordered the company to pay a fine of RM3,000 or seven days’ jail for each charge.
On the first count, the company was found having for sale 21 units of the unregistered Lianhua Qingwen Jiaonang that has been used as an alternative treatment for Covid-19, at March 23, 2021 at 10.30am at Istana Ayam Tua in Tuaran.
On the second count, the company had another 18 units of Lianhua Qingwen Jiaonang and 28 units of hand-sanitisers which were not registered with the Ministry of Health (MOH) on Sept 7, 2021 at the same place and time.
On the third count, the company was found having five types of unregistered products namely, 12 units of YDBY Non-Water hand washing gel, 62 units of Cool Day’s Original Instant hand-sanitisers, two units of Nake hand sanitisers, five units of Limeijiujiou (Botol Jernih) hand sanitisers and one unit of Limeijiujiou (Botol Biru).
The offence took place at the same place and time at Istana Ayam Tua in Putatan Platinum Plaza.
The offence, under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 and punishable under Section 12(2) of the Drug Sales Act 1952, which carries a jail term of up to three years or a fine of up to RM50,000, or both, on conviction.
On the fourth count, the company was found to have four types of cosmetics without notification at the same place and time.
On the fifth count, the company had two types of cosmetics without notification on the same day at Istana Ayam Tua in Tuaran.
