
Kota Kinabalu: A company was fined a total of RM3,800 for having unregistered products and cosmetics without labels.
YKL Borong Runcit Sdn Bhd through its representative pleaded guilty before Sessions Court Judge Ummu Khaltom Abd Samad, to the two charges against the company, on Wednesday.
On the first count, the company was fined RM1,800 for having the unregistered product which was 88 bottles of Kilei Hand Sanitizer Liquid at 10.30am on June 23, 2022 at the company premises in Plaza 22, Kg Sapat, Papar.
The product was not registered with the Health Ministry.
The company committed the offence under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 and punishable under Section 12(2) of the Drug Sales Act 1952 which carries a jail term of up to three years, or a fine of up to RM50,000 or both, on conviction.
On the second count, the company was fined RM2,000 for having two types of cosmetics namely, 61 bottles of Kilei Hand Sanitizer Moisturise with tea tree oil and 17 bottles of Prowell Sanitizing Solution without notifications at the same place and time.
During mitigation, the company’s representative asked for leniency.
However, Prosecuting Officer Abu Suffian A.Rahman from the Pharmacy Department, urged the court to impose an appropriate sentence as the company committed the offence which could risk the public’s health as the products was not registered to the Health Ministry and no labels.
