Unregistered products: Man, worker get fine

Kota Kinabalu: A 45-year-old man and his Indonesian worker were fined RM6,000 for having unregistered products.

Abu Barra Berahim and Melissa Alias pleaded guilty separately before two different Sessions Court judges.

Judge Noor Hafizah Mohd Salim ordered Abu to pay RM2,500 or spend 30 days’ jail for having seven types of unregistered products at 6pm on Nov 29, 2019 at Blok SH15-4B-3 in Taman Suria Apartment here.

Melissa was fined RM3,500 or six months’ jail by Judge Ummu Khaltom Abdul Samad, for having 10 boxes of unregistered Morosil S at the same place and time.

The offence under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 and punishable under Section 12(2) of the Drug Sales Act 1952 which carries a jail term of up to three years, or a fine of up to RM50,000 or both, on conviction.

During mitigation, they asked for leniency.

However, Prosecuting Officer Anitha Uthayakumaran from the Pharmacy Department, who prosecuted in both cases, urged the court to impose an appropriate sentence as the duo had committed an offence which could risk the public’s health as the products were not registered with the Health Ministry.
