Kota Kinabalu: An owner of vape shop was fined RM3,000 or two weeks’ jail for having for sale 10 types of liquid for electronic cigarette (vape) containing poison without licence. Sessions Court Judge Azreena Aziz handed down the sentence to Mohd Hisam Maslim, 40, pleaded guilty to the charge against him on Tuesday.
Mohd Hisam was found selling the liquids namely three bottles of Ais Batu Campur, three bottles of Sumandak Juice Choco Susu, one bottle of Sumandak Juice Honeydew Lemonade, one bottle of Jambu 888, six bottles of Blueberry Jem Ice, three bottles of Mr Juicer Apple Flame, 10 bottles of Mr Juice Mix Berry, four bottles of Ric Co. Pink Guava Salt, three bottles of Ric Co. Mango Crush Salt and 13 bottles of Liberty Mango Lassi.
All liquids contained nicotine which is listed in First Schedule of Poison Act 1952.
The offence took place at 3pm on Aug 20, 2019 at the Angkol AV Mobile in Grace Square PH 11 in Sembulan, near here.
The offence, under Section 13 (a) of the Poisons Act 1952 and punishable under Section 32(2) of the same Act, provides for a fine of RM3,000 or a jail term of up to a year, or both, on conviction.
In another case, a company was also ordered to pay RM3,000 for having for sale product containing poison without licence. The sentence was handed to Hua Hing Dried & Frozen Seafood after its representative admitted to the charge.
The company had 600 pieces of Hamer 37F82K Ginseng & Coffee containing poison which was Tadalafil without licence at 2.30pm on Oct 9, 2019 at the company premise in Sedco Complex here.
During mitigation, the representative asked for leniency as it was the company’s first offence. The representative also informed the court that they did not know that the products cannot be sold.
The prosecution urged the court to impose an appropriate sentence.
