Kota Kinabalu: A 46-year-old man was fined RM25 or a day’s jail, Monday, for behaving in a way that disturbed public order.

Mohd Firdaus Ahmad pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to committing the offence against police officer Dolis Anak Rantai at 6.40pm on Oct 2 in Sepanggar.

AdvertisementThe offence, under Section 8(1) (e) of the Minor Offences Ordinance which is punishable under Section 8 (1) of the same Ordinance, provides a fine of RM25 or not more than a week’s jail on conviction.

According to the prosecution, at 6.40am on Oct 2 this year, Dolis was carrying out traffic control duty at an accident area on Sepanggar road and asked the public to not disturb the police’s work.

Read more Firdaus was dissatisfied when he was prohibited from viewing the accident victim, used vulgarities towards Dolis, which caused him to file a police report for further action.

Firdaus, who was not represented, requested for leniency while the prosecution applied an adequate sentence.

Rajesh Awot pleaded not guilty to committing the offences on Dec 20 at 3.30pm at Taman Fajar Menggatal.

On his second count, he allegedly kept two stolen red/white rear lights with Hilux inscription belonging to the same person.

Each charge under Section 411 of the Penal Code carries a jail term of between six months and five years and liability of a fine, or both, on conviction.

The prosecution, in applying for a pre-trial case management (PTCM) date, stated that no bail was offered.

Duty counsel Lim Ming Zoong, who was representing the accused, requested for a bail of RM2,000 per charge and both charges can be the same sureties.

The court set Feb 24 for PTCM on the first count and Feb 20 for the second count and released the accused on a bail of RM2,000 for each count with two sureties and report to the nearest police station once a month.
