Weapon is in Kuala Lumpur, so case is deferred

Kota Kinabalu: A 23-year-old man who allegedly slashed his brother with a machete (parang), will see his case was deferred for another one month as the machete he used in committing the crime is still in Kuala Lumpur.

Sessions Court Judge Ummu Khaltom Abdul Samad set Oct 14 this year for mention again for Mecralinsius Subin’s case.

Wednesday was supposed for Mecralinsius’ sentencing but the prosecution applied for another date pending the availability of the machete requested by Mecralinsius, to see the weapon before sentencing.

However, the prosecution informed the court that the weapon is still in Kuala Lumpur.

Mecralinsius had on July 29 this year pleaded guilty to the charge but his sentencing was deferred as he wished to see the machete.

He is accused of causing grievous hurt to his brother Willi Subin, 34, by using the machete at 1am on July 16 this year at house in Kg Sokid Bundu Tuhan, Ranau.

The offence under Section 326 of the Penal Code and read together with Section 326A of the same Code which provides for a jail term of up to 20 years, and liable to a fine or whipping, on conviction.

Mecralinsius, who was not represented, was ordered remanded further pending the date.

Deputy Public Prosecutor (DPP) Siti Hajar Mazlan appeared for the prosecution.

In another case, the court set Oct 13 this year for further mention involving a 23-year-old man charged with three counts of raping a woman as well as putting his fingers into the woman’s private part and anus.

Sessions Court Judge Elsie Primus fixed the date for Stellee Kintoh, following the request by the prosecution for another mention date pending the medical and forensic reports.

On the first count, Stellee is accused of raping the 21-year-old woman while putting her in fear at 7am on April 12 this year at the kitchen of a house in Kg Radu, Kota Marudu.

The offence under Section 376(2(b) of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

On the second count, he allegedly put his index finger into the same woman’s anus at the same place and time.

On the third count, he is accused of inserting his four fingers into the woman’s private part at the same place and time.

So far, no plea was recorded from Stellee when he was brought up in court on May 10 this year. DPP Mas Izzaty Lokman prosecuted.
