
Kota Kinabalu: A 30-year-old woman was jailed seven years for having 33.26gm of syabu last year.
Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to Ivy Jenhol who pleaded guilty to the charge.
Ivy was found having the drug at 2.14pm on Nov 9, 2021 by the roadside in front of the Kedai Kent FJ Unisex Saloon in Taman Telipok Ria, Telipok.
The offence under Section 12(2) of the Dangerous Drugs Act and punishable under Section 39A(2) of the same Act which carries a jail of between five years and life imprisonment, and whipping at least 10 strokes of the cane, on conviction.
The court ordered Ivy to serve the jail sentence from the date of her arrest on Nov 9, 2021. But whipping was not imposed due to her gender.
During mitigation, Ivy who was not represented, asked for leniency saying that she has two children to look after.
However, Deputy Public Prosecutor Nur Faezah Jafry urged the court to hand down a deterrent sentence considering the rampancy of the offence.
Meanwhile, 15 people were penalised by the Magistrate’s Court here for committing drug-related offences.
Fourteen of them pleaded guilty to taking drugs while one man admitted to having syabu.
The 14 were Herman Amri, Jimmy Lazarus, Azmin Redson, Rojem Dalpa, Melvin Matdi, Hasan Abdul, Victor Joseph, Jelengai Lutau, Aleno Zakarula, Amin Saili, Benareh Janatih, Fauzi Syam, Mashur Abdul and Arnold Ryan.
They were arrested at different locations here and in Penampang between Feb last year and June this year, after being tested positive for syabu and amphetamine, the prosecution informed the court.
Herman was sentenced to nine months’ jail while Jimmy was jailed eight months.
Arnold was fined RM2,000 or six months jail while the rest were handed seven months jail each.
Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
Meanwhile, the other man, Baharudin Haling, 45, admitted to having 0.15gm of syabu at Inanam on Nov 28, 2021.
He was fined RM2,500 or 10 months jail.
The charge under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both on conviction.
The 15 were brought before Magistrate’s Lovely Natasha Charles and Jessica Ombou Kakayun.
