PETALING JAYA: The Kuala Lumpur sessions court has sentenced a former college administrative assistant to five years in prison and a RM90,000 fine on two charges of trafficking a 13-month-old baby and forging its birth documents in 2020.
Judge Azura Alwi imposed the sentence on Nurul Faizan Ahmad Asri, 40, after the defence failed to raise a reasonable doubt.
She allowed a stay of the prison sentence pending an appeal to the High Court, but ordered the accused to pay the fine today.
In her judgment, Azura said the baby’s biological mother handed him over to a witness, demonstrating a clear violation of Section 14 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007.

“The defendant’s denial of knowledge of the contents of the envelope with the false documents to register the baby’s birth was also a mere denial,” she said, according to Harian Metro.
Nurul Faizan was charged with trafficking the baby boy for the purpose of exploitation at Taman Desa Hospital, Jalan Klang Lama, at 5pm on Nov 5, 2020.
She was charged under Section 14 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007, which carries a minimum jail sentence of three years or a maximum of 20 years and a fine, upon conviction.
She was also charged with knowingly using a false national registration department (JPN) birth registration form, along with attachments, in the baby’s name, at the Kuala Lumpur branch of JPN in November 2020.
She was charged under Section 471 of the Penal Code for using a forged document, punishable under Section 468 of the same code, which provides for a maximum prison sentence of seven years and a fine, upon conviction.
Thirteen prosecution witnesses and one defence witness were called during the trial, which began on Sept 1, 2022.
