Kota Kinabalu: A 40-year-old woman was jailed 15 months by the Magistrate’s Court, here, on Friday for providing false information when applying for a MyKad for a child who was not her biological child.
Noraini Kenedy pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to giving false information as the child’s guarantor when applying for the identity card at the National Registration Department (NRD) on Nov 30, 2023.
She was charged under Regulation 25(1)(b) of the National Registration Regulations 1990 (Amendment 2007), which carries a maximum three-year jail term or a fine of up to RM20,000, or both.
The court heard that the Tawau NRD lodged a complaint on Jan 9, 2024 after detecting an application for a 12-year-old child suspected of using a birth certificate belonging to another person.
Investigations found that Noraini had falsely claimed to be the child’s biological mother and acted as the guarantor for the MyKad application.
She had also submitted the birth certificate of her own biological child when applying for the other child’s first identity card at the Tawau NRD.
The application was approved and a MyKad was subsequently issued based on the false information provided.
A DNA test later confirmed that the child whose birth certificate was used and the complainant were biological siblings.
Further investigations found that Noraini had sold her biological child’s birth certificate to another individual for use by a different child.
The court also heard that Noraini had previously taken the child to the NRD office in Kota Kinabalu for a MyKad application but left the child at a hotel.
Noraini was arrested at the Sabah NRD Investigation and Enforcement Division on Sept 8, 2026.
She was ordered to serve her sentence from the date of arrest.
