Malaysians can now move on with their lives instead of being besieged by the news on the future of PM6.
Now that he has been pardoned, PMX and the Madani government, who owns 1MDB and SRC International should also give instruction to both entities to cease and withdraw all civil actions they have initiated against PM6 immediately.
As the Attorney General said in his justification for the discontinuation of the case against the President of UMNO, 1MDB and SRC should save time and costs of the court and all parties involved in the case now that PM6 has been pardoned.
Even if both entities were to pursue and continue with their civil suit, any judgments in their favor will be a hollow victory.
PM6 will definitely appeal against any judgment against him to the Court of Appeal and then to the Federal Courts.
That will take another few years.
At the end, what does both entities i.e 1MDB and SRC hopes to achieve if the Courts were to rule in their favor?
Enforce the judgement and initiate bankruptcy against PM6 for the judgment sums?
As his lawyer argued in the bankruptcy action against PM6 by LHDN, if the bankruptcy were to proceed, PM6 would not be able to revert himself into a position that he was before the judgement and he will lose everything and it is an irreparable damage.
PMX and the Madani government should let bygones be bygones.
What has happened has happened.
In Malaysia, having a criminal record does not automatically ban a person from standing for election unless the conviction meets specific legal thresholds under Article 48(1)(e) of the Federal Constitution.
Under Article 48(1)(e), a person is only disqualified from running for Parliament or State Legislative Assemblies if:
- They are convicted of an offense by a court.
- They are sentenced to a prison term of not less than one year, OR
- They are fined not less than RM2,000 (specifically, RM2,001 and above, as clarified by court rulings).
Exceptions, however, are applicable if it is a,
- Free Pardon: If the individual receives a free pardon, the disqualification does not apply.
- Removal of Disqualification: Even without a free pardon, the Yang di-Pertuan Agong has the power to remove the disqualification under Article 48(3).
Let’s hope PM6 will receive another pardon under this article, Article 48 (3) for him to come back and stand as a candidate in the next GE.
