A young couple has pleaded guilty in the Sessions Court today to charges of neglecting their one-week-old baby boy on May 18. The defendants, Nur Aisyah Azila Zairul Akmal, 21, and Muhammad Alhafiz Mukminin Mohd Noor, 24, admitted their guilt after the charges were read to them before Judge Wan Suhaila Mohd.
The couple was jointly charged with neglecting their baby in a manner likely to cause physical injury. The alleged offense took place at a shop on Jalan Air Putih between 7:00 a.m. and 7:15 a.m. on May 18.
The charge falls under Section 31(1)(a) of the Child Act 2001, which is punishable under Section 31(1) of the same Act, and is read in conjunction with Section 34 of the Penal Code. If convicted, the couple could face a maximum fine of RM50,000, a prison sentence of up to 20 years, or both.
Judge Wan Suhaila set bail at RM2,000 for each defendant with one surety and scheduled sentencing for May 28.
Deputy Public Prosecutor Syairah Mohamad Razali represented the prosecution, while the accused were defended by lawyer Nurul Farhana Shamsudin from the National Legal Aid Foundation.
According to case details, the newborn baby boy was discovered shivering on the floor of a shop by a chicken truck driver at approximately 7:30 a.m. on May 18. The baby, who weighed three kilograms, was born on May 12 at a house in Jabur Kubur. The baby was subsequently abandoned at the shop six days later. The couple was apprehended on Monday at two separate locations.
This incident has highlighted the severe consequences of child neglect and the legal repercussions faced by those responsible. The Child Act 2001 and the Penal Code impose stringent penalties to protect children's welfare and ensure their safety. In this case, the court's decision will serve as a stern reminder of the gravity of such offenses.
The young couple's admission of guilt underscores the importance of responsible parenting and the legal obligations that come with it. As the court prepares to sentence them, the case serves as a crucial example of the justice system's role in upholding child protection laws and the severe penalties for those who fail in their duty of care. The outcome of the sentencing on May 28 will be closely watched, as it will reinforce the legal framework designed to safeguard the rights and well-being of children in Malaysia.
