SEREMBAN – The High Court here is scheduled to hear a case management proceeding on Wednesday involving 10 Negeri Sembilan state assemblymen challenging the cancellation of their appointments as state executive council (Exco) members on Sept 24.

The proceeding is scheduled for 4.30pm via video conference before High Court judge Roz Mawar Rozain.

The originating summons was filed on Oct 5 by the law firm Hafarizam Wan & Aisha Mubarak against the Negeri Sembilan State Secretary and the Negeri Sembilan state government.

The applicants are seeking a declaration that the cancellation of their Exco appointments, gazetted under the Negeri Sembilan Government Gazette N.S. P.U. 18 dated Sept 24, 2026, is null and void, invalid and of no effect, on the grounds that it was allegedly made without the advice of the Menteri Besar.

The 10 applicants are Datuk Mohd Faizal Ramli (Linggi assemblyman), Datuk Zaifulbahri Idrisi (Chembong assemblyman), Datuk Mustapha Nagoor (Palong assemblyman), Siow Kong Choon (Chennah assemblyman) and Siti Nur Umaira Hasim (Labu assemblywoman).

The remaining applicants are Datuk Mohd Asna Amin (Lenggeng assemblyman), Datuk Mohd Razi Mohd Ali (Sungai Lui assemblyman), Suhaimizan Bizar (Gemencheh assemblyman), Mohd Fairuz Mohd Isa (Serting assemblyman) and Datuk Razali Abu Samah (Sikamat assemblyman).

One of the main questions raised is whether the appointments of Exco members, other than the Menteri Besar, can be revoked solely through the withdrawal of consent by the Yang di-Pertuan Besar without the advice of the Menteri Besar.

The applicants are also seeking a declaration that Article 38(5) of the Negeri Sembilan State Constitution 1959 must be read together with other relevant provisions to determine the procedure for revoking Exco appointments.

The application seeks, among other things, a court ruling on the interpretation of the state constitution concerning the powers and procedures governing the revocation of Exco appointments.

The applicants’ claims have yet to be determined by the court.
