The accused, identified as Goh Wey Haur, pleaded not guilty to all three charges when they were read out before magistrate Aliya today. He was granted bail of RM36,000, with the court ordering him to surrender his passport and temporarily suspending his driving licence until the case is concluded.

Three charges, including dangerous driving causing death

According to the first charge, Goh allegedly drove a BYD Seal (registration number VLV 1129) dangerously along Jalan Kuching, heading from the city centre towards Segambut, at about 3.44pm on October 10. His alleged driving resulted in the death of five-year-old Aisyah. He was charged under Section 41(1) of the Road Transport Act 1987 for causing death by reckless or dangerous driving.

The second charge relates to allegedly driving the same vehicle in a manner that endangered other road users, in breach of Section 42(1) of the same Act.

The third charge alleges that he failed to stop after the accident, an offence under Section 2(1), punishable under Section 119(2) of the Road Transport Act 1987.

How the crash happened

According to an earlier statement by Kuala Lumpur Traffic Investigation and Enforcement Department chief ACP Mohd Zamzuri, preliminary investigations found that traffic was moving slowly when the BYD allegedly hit a Perodua Bezza from behind.

The driver allegedly left the scene after the collision. The impact also involved a motorcycle, while the Bezza spun out of control into the right lane and struck three other vehicles, a Nissan Almera, a Toyota Alphard and a Perodua Myvi.

Aisyah, who was seated in the rear of the Bezza, suffered severe head injuries. She was rushed to Kuala Lumpur Hospital for treatment but later died.

Police subsequently arrested the suspect at a private hospital in Damansara at around 11.30am yesterday, after he was discharged.
