4 men plead not guilty to smuggling

SANDAKAN: Four local men aged between 34 and 48 pleaded not guilty in the Magistrate’s Court here on Thursday to possessing more than 5.2 million sticks of contraband cigarettes worth RM476,938.40.

The men were charged before Magistrate Yong Ching Hong with possessing 20 types of cigarettes of various brands, which are prohibited from being imported under the Customs (Prohibition of Imports) Order 2023.

The offence was allegedly committed at 5pm on July 13, 2024, at a premises in Batu 3, Sandakan.

The charge was framed under Section 135(1)(d) of the Customs Act 1967, read together with Section 34 of the Penal Code, and is punishable under Section 135(1)(v)(aa) of the Customs Act.

The court fixed Sept 30 for the next mention date.

All accused were granted bail of RM8,000 each with two sureties, and must report to the nearest customs office once a month as an additional condition.

The prosecution was conducted by Prosecuting Officer Azizah Talibe from the Royal Malaysian Customs Department, while the accused were represented by counsel Siti Marzalia Mursidi.
