Man on cannabis charge ordered to enter defence

A 26-year-old man was ordered to enter his defence on a charge of having 129.36gm cannabis.

Sessions Court Judge Elsie Primus fixed Oct 5 and 6 for Muhamad Danial Mohamad Deris’ defence after ruling that the prosecution had established a prima facie case against him.

Muhamad Danial is accused of having the cannabis at 11.15pm on June 14, 2019 at the car park of University Utama Condominium at Jalan Kayu Madang in Telipok.

The offence under Section 6 of the Dangerous Drugs Act 1952 punishable under Section 39A of the same Act which carries a jail between five years and life imprisonment, and whipping at least ten strokes of the cane, on conviction.

The prosecution called five witnesses during the hearing.

Deputy Public Prosecutor Rustam Sanip appeared for the prosecution while counsel Nelson Anggang defended Muhamad Danial.

In another case, a 39-year-old man was charged with having a knife at public area without a permit.

However, no plea was taken from Maslan Lamang who is accused of having the knife at 1.25pm on Aug 24 this year under the stairs of Block G, Taman Puri Warisan, Inanam here. 

He was charged under Section 6(1) of the Corrosive and Explosive Substance and Dangerous Weapons Act 1958, which provides for a jail term of between five and 10 years, with whipping, on conviction. 

The court set Sept 22 for mention and ordered Maslan to be remanded further pending the date.
