Fined for keeping stolen CCTV recorder

Kota Kinabalu: A 44-year-old man was fined RM1,800 or two months jail by the Magistrate’s Court here Friday for keeping a stolen CCTV recorder.

Chong Shu Chern, a workshop worker pleaded guilty before Magistrate Jessica Ombou Kakayun to having the stolen item belonging to one Abd Jalil Salih at 6.30am on Oct 21 at Kedai Runcit Razi Enterprise in Kepayan Ridge here.

Chong was jointly charged with another accused, Bong Wei Teck to the charge under Section 411 of the Penal Code which carries a jail term of up to five years or fine or both on conviction.

Bong, a 34-year-old cook, however, pleaded not guilty to the charge.

The court set Dec 15 for Bong’s case management and released him on a bail of RM1,800 in two sureties.

Inspector Albert Basiri, in tendering the facts of the case of Chong’s case, said that Chong was arrested by police  following a report lodged by Jalil, who claimed that his shop was broken into on Oct 21 and that several items were stolen including the CCTV recorder.

Counsel Farazwin Haxdy, representing Chong, applied for a lenient sentence on the grounds that Chong was detained by police since Oct 25 and was remorseful of his action.

Farazwin also submitted that the imprisonment sentence was not suitable for Chong because it would expose him to Covid-19 as the Kepayan Prison is currently under the Enhanced MCO.

In the same court, a 21-year-old man claimed trial to having a stolen boat hydraulic steering.

Alshiddin Roslan was accused of having the item at 9am on Oct 23 in front of a house at Kg Sembulan Lama here.

The complainant in the case, who was present informed the court that he wished to withdraw the case and that he had lodged a police report to retract his previous report regarding the theft.

The complainant said he made the decision voluntarily as he pitied the accused who has two small children.

The court fixed Dec 15 for mention pending instruction from the Deputy Public Prosecutor’s office and offered Alshiddin bail at RM1,000 in two sureties.

Duty counsel Lim Ming Zong @ Lawrence, representing Alshiddin applied for a lower bail on the grounds that he has two children and was the sole breadwinner of his family.

Meanwhile, a 33-year-old man was also charged with a similar offence.

Mohd Paisal Dulmumin pleaded not guilty to having a stolen sling bag and a stolen wallet at 3.50pm on Oct 20 in front of the 7–Eleven convenience store at Indah Permai in Manggatal.

The prosecution in applying for a case management date proposed bail at RM8,000 on the grounds that Paisal has at least six conviction records for taking syabu and having syabu.

Duty Counsel Lim, requested a lower bail on the grounds that Paisal has three children and was unemployed but used to work as a forklift driver before the CMCO.

The court set Dec 18 for case management and offered Paisal bail at RM2,000 undeposited in two sureties.
