Jobless man charged with assaulting wife

Kota Kinabalu: A 23-year-old jobless man was charged with assaulting his wife and taking drug repeatedly.

Mohd Shafiq Shazreen John pleaded not guilty before Sessions Court Judge Elsie Primus, to both charges against him on Tuesday.

On the first count, Mohd Shafiq is accused of voluntarily causing hurt to his 24-year-old wife by using a helmet at 9am on Dec 4 this year at a house in Inanam.

The offence under Section 324 of the Penal Code and punishable under Section 326A of the same Code which provides for a jail term of up to 20 years, and fine, or whipping, on conviction.

On the second count, he allegedly took syabu for the third time after two previous convictions for taking the drug.

The offence under Section 15(1)(a) of the Dangerous Drugs Act 1952 and read together under Section 39C (1)(b) of the same Act provides for a jail term of between five and seven years, and whipping, on conviction.

The court set Jan 15 for mention of the cases.

Mohd Shafiq was ordered remanded further pending the disposal of his case following an objection by the prosecution.

Earlier, Deputy Public Prosecutor Mas Izzaty Lokman objected to bail Mohd Shafiq on the grounds that the alleged victim, in that case is his wife and that he might tamper with the witness.

Mas Izzaty also informed the court that the medical and pathology reports as well as Mohd Shafiq’s previous convictions record are not ready yet.

Mohd Shafiq was not represented.
