Incest: Man to go on trial Feb 15-16

Kota Kinabalu: A 48-year-old man, charged with raping his daughter, will go trial on Feb 15-16 this year.

Sessions Court Judge Elsie Primus set the date for the man who maintained his not-guilty plea.

The man is accused of committing incest against the 15-year-old girl between midnight and 1am in May 2020 at a house in Pulau Gaya, near here.

He was charged under Section 376(3) of the Penal Code which carries a jail term of between eight and 30 years and whipping, on conviction.

All the documents pertaining to the case had been served to the man.

Deputy Public Prosecutor (DPP) Mas Izzaty Lokman, who stood in for DPP Rustam Sanip, appeared for the prosecution.

Meanwhile, the trial of the case involving two men charged with gang robbery had been set for June 10-11 this year.

The date was fixed for Mohammad Faidzal Abrahim and Mohd Dul Jamal.

The duo allegedly robbed one Kasman Etuk, 19, by using a machete and made off with RM500 belonging to the Kedai Rana Enterprise.

The offence allegedly took place at 4.30am on Oct 20, 2019 at the counter of the shop in Manggatal.

The prosecution informed the court that about six witnesses would be called during the hearing.
