Duo charged with cheating a man

Kota Kinabalu: Two individuals were charged at the Magistrate’s Court here Friday with cheating a man of money amounting to RM12,500.

Pensioner Rafiah Ahmad and self-employed Azman @ Abdul Ramin Kunji, both 62, pleaded not guilty before Magistrate Jessica Ombou Kakayun to the charge framed against them respectively.

Rafiah was accused of cheating one Ahmad Zidni of RM10,500 allegedly for the purpose of processing a marriage certificate on Feb 5, 2020 at Restoran Jamal Salim in Sembulan.

The charge stated that the complainant allegedly transferred the money into Rafiah’s bank account.

Meanwhile, the other accused, Azman, allegedly cheated the same victim of RM2,000 by way of transferring the money into Azman’s bank account, for the purpose of processing a birth certificate.

The offence allegedly took place at Wisma Muis in Sembulan on July 2, 2020.

Rafiah and Azman were charged under Section 420 of the Penal Code, which carries a jail term of between one year and 10 years, with whipping and liability of a fine on conviction.

The prosecution in applying for a case management date, proposed bail at RM5,000 in two sureties on each accused.

Duty counsel Lim Ming Zoong @ Lawrence, representing both Rafiah and Azman, applied for a lower bail sum.

Lim told the court that Rafiah was a pensioner and a single mother of three children while Azman was married with six children and was self-employed.

The court set case management on March 3 for Rafiah’s case and released her on a bail of RM3,000 in two sureties.

Azman was offered bail at RM2,000 in two sureties pending case management on March 17. Inspector Albert Basiri prosecuted.
