Duo get five years each and cane for taking drugs repeatedly

Kota Kinabalu: Two men, who has previous conviction records of taking drugs were each jailed five years and ordered to be caned once by the Sessions Court here for committing similar offence.

Asli Selok, 53, and Abdul Rahim Sabli, 33, pleaded guilty separately before Judge Azreena Aziz to taking amphetamine and syabu.

The charge stated that Asli, who had committed the offence at 3.15pm on April 26, 2020, here had four conviction records on similar offence in 2014, 2016, 2017 and 2018.

Abdul Rahim who committed the offence at 7.30pm, on June 15, 2020 in Beaufort, had two conviction records also for similar offence in 2018 and 2019.

Asli and Abdul Rahim were charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 and read together under Section 39C(1)(b) of the same Act, which provides for a jail term between five years and seven years and whipping of not more than three strokes of the cane and police supervision between two years and three years, on conviction.

Both Asli and Abdul Rahim, who were not represented, requested for leniency.

The prosecution applied for a deterrent sentence on the grounds that both men were habitual offenders based on their previous conviction records.

The court also ordered Asli and Abdul Rahim to be placed under police supervision for two years each after completing their sentences.

Deputy Public Prosecutors Siti Amirah Muhammad Ali and Nureen Natasha Mohd Raffie prosecuted.
