Man fined over death of m-cyclist

Kota Kinabalu: A 27-year-old man was fined RM5,5000 or six months’ jail for careless and inconsiderate driving which resulted in an accident that caused the death of a motorcyclist.

Hamzad Fahmi Ahmad Jani pleaded guilty before Magistrate Jessica Ombou Kakayun to the charge, Wednesday.

Hamzad committed the offence along Jalan Simpang Klinik Kesihatan Putatan at 10.

50am on Aug 11, 2019.

The offence under Section 43 (1) of the Road Transport Act 1987 (333/87) carries a jail term of up to a year, or a fine of between RM4,000 and RM10,000, or both, upon conviction.

During mitigation, Hamzad asked for leniency.

Traffic Prosecuting Officer Inspector Mohd Firdaus Che Mustafa urged the court to impose an appropriate sentence.

The court heard that the incident happened when Hamzad was making U-turn when the motorcyclist rammed into his car.

The motorcycle skidded and hit the road shoulder before he was thrown into the drain.

The motorcyclist was sent to Queen Elizabeth Hospital 1 for further treatment but was pronounced dead at 11.

25am on the same day.

Hamzad did not suffer any injuries.

The court ordered Hamzad’s conviction to be endorsed on his driving licence.
