Man claims trial to having drug

Kota Kinabalu: A 32-year-old man claimed trial to having 32.14gm of syabu.

Mohd Fauzi Roslim made the plea before Sessions Court Judge Elsie Primus, after the charge was read to him, Wednesday.

Mohd Fauzi is accused of having the drug at 4.35pm on Dec 17, 2020 in front the Borneo Auto Enterprise in Sulaman Sentral, Manggatal, here.

The offence under Section 39A(2) of the Dangerous Drugs Act carries a jail term of between five years and life imprisonment, and whipping at least 10 strokes, upon conviction.

The court set June 22 for case management and Nov 8 and 23 to hear the case.

No bail was offered to Mohd Fauzi pending the date as the charge against him has no provision for bail.

The court also ordered Mohd Fauzi’s case to be tried together with his case from the Magistrate’s Court which had been transferred to the same court after the proceedings.

Earlier, Deputy Public Prosecutor Rustam Sanip informed the court that Mohd Fauzi has a case in Magistrate’s Court and applied for a joint trial as it was same transaction.

Counsel Amli Nohin who defended Mohd Fauzi, raised no objection.

The prosecution said about 10 witnesses would be called in the hearing.

After the proceedings in Sessions Court, Mohd Fauzi was brought to Magistrate’s Court.

Magistrate Lovely Natasha Charles transferred Mohd Fauzi’s case to the Sessions Court.

For the charge in Magistrate’s Court, Mohd Fauzi is accused of having 1.3gm of syabu at the same place and time.

No plea was taken from Mohd Fauzi for the charge.
