Kota Kinabalu: A 35-year-old labourer was charged in the Magistrate’s Court here Thursday with trafficking 100.36gm of syabu.
Azrul Adjeran, who appeared before Magistrate Lovely Natasha Charles, was accused of committing the offence at 5.45pm on May 4, this year in front of a security guard kiosk at Taman Bakti Ikhlas in Inanam.
However, no plea was recorded from Azrul after the charge was read out to him, who was in central lock up in Kepayan, via video conferencing.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment with either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The prosecution applied for a new mention date while waiting for the chemist’s report and objected to bail as the charge has no provision for bail.
Lovely set June 19 for mention and ordered Azrul be further remanded.
Azrul was not represented.
Meanwhile, a 37-year-old man was sentenced to 14 months jail for having 1.46gm of syabu.
Kimyong Lobinjang pleaded guilty to having the drug in a house here at 1.3pm on March 4 this year.
He was ordered to serve the jail term from the date of his arrest.
The offence under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both on conviction.
In the same court, five men were charged with taking syabu and amphetamine.
However no plea was taken from the men after the charges were read to them via video conferencing.
The prosecution applied for a new mention date pending the availability of the pathology reports and proposed bail at RM3,000 in two sureties each.
The court set mention between June 16 and June 22 and released the accused on a bail between RM1,100 and RM1,000.
Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail on conviction.
