Threatening niece: Man jailed and fined

Kota Kinabalu: A 47-year-old unemployed man, who threatened to injure his niece for not giving him money, was sentenced to three months’ jail and fined RM2,000, or four months’ jail, on Thursday.

Sabahalim Abdurait pleaded guilty before Magistrate Lovely Natasha Charles to threatening one Nuranisah Adam at 12.45pm on Dec 8, 2021 in a unit at Taman Jaya Diri, Jalan Sepanggar, Manggatal.

Inspector Kelvan Elson Maik, prosecuting, told the court that on the said day, while Nuranisah was at home, Sabahalim, who was her mother’s older brother, came and asked for money from her telling her that he wanted to go to the clinic.

When Nuranisah told Sabahalim that she has no money at the time, Sabahalim went berserk and wanted to beat her but the complainant managed to avoid being hit, the court heard.

Sabahalim hit the television rack before leaving the house, said the prosecution.

He was arrested by police the next day following a report lodged by Nuranisah who feared the safety of her family as there were also small children in the house, the court heard.

Police investigations revealed that such incident happened many times and that Sabahalim’s mother had lodged a police report three times previously about his temper, said Kelvan.

Unrepresented, Sabahalim requested leniency and wanted to pay for a fine. He was charged under Section 506 of the Penal Code which carries a jail term of up to seven years or fine, or both, on conviction.

In another case, a 69-year-old fishmonger was jailed three months for trespassing an oil platform area to fish.

Kabumani Sammaani admitted to committing the offence at the ERB West oil platform area, at 8.30pm on Dec 20, 2021.

The court heard from the prosecution that Kabumani was arrested by police at Kg Laban, Gaya island, following a report lodged from Petronas on the trespassing incident.

A fishing boat and two engines were also seized from Kabumani. Kabumani, who was represented by counsel Dominic Chew, requested leniency.

Meanwhile, a 35-year-old man was fined RM1,000 or two months’ jail for having illegal gambling paraphernalia.

Unemployed Rynddy Tatiu pleaded guilty to having four pieces of Wahui riddles without licence at 4.30pm on Jan 19, this year at the five-foot-way of a shop at Putatan town.

Kelvan told the court that the police detained Rynddy and found gambling paraphernalia including RM55 from him.

Duty counsel Lim Ming Zoong @ Lawrence, who represents Rynddy, applied for a lower fine.

Rynddy was charged under Section 9(1) of the Common Gaming House Act which carries a jail term of up to six months, or fine of up to RM3,000, or both, on conviction.
