
Kota Kinabalu: A 42-year-old man was on Monday sentenced to one day jail and fined RM11,000 or three months’ jail for drink-driving, two years ago.
Octivian Severinus pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at 12.37am on Nov 14, 2020 at Jalan Kolam here.
The charge, under Section 45A(1) of the Road Transport (Amendment) Act 2020, provides for a jail term of up to two years and fine of between RM10,000 and RM30,000 and lost qualification from holding or getting a driving licence for not less than two years from the date of conviction.
Traffic Prosecuting Officer Inspector Mohammad Khairul Nizam Mokhtar informed the court that Octivian committed the offence during a police patrol and snap check at the said area.
Counsel Luke Ressa Balang, representing Octivian applied for a lenient sentence on the grounds that it was his first offence.
The court also ordered for Octivian to be disqualified from holding or obtaining a driving licence of not less than two years from the date of the conviction.
In another case, a 46-year-old trader was fined RM25 or two days’ jail for peeping at a woman through her room window.
Nordin Dulahim admitted to committing the offence with the intention to breach peace at 6.30pm on Nov 19, 2021 at a rented house at Kg Sri Sindil, Putatan.
Inspector Kelvan Elson Maik, prosecuting, told the court that Nordin was caught red-handed by the 30-year-old woman’s father.
When approached by the victim’s father, who then reprimanded him, Nordin brushed the father’s hand away which ensued a fight between them, before their neighbours calmed them.
Nordin, who was not represented, requested leniency by saying that he would not commit a similar offence in the future.
He was charged under Section 8(1)(e) of the Minor Offences Ordinance which provides for a RM25 fine on conviction.
