
Kota Kinabalu: The Magistrate’s Court here ordered an eatery operator to enter his defence to a charge of cheating a woman of RM4,000 over a wedding package.
Magistrate Jessica Ombou Kakayun made the order on Thursday on Mohd Nassir Aziz, ruling that prosecution had established a prima facie case against him.
The court fixed April 8 for Nassir’s defence.
Nassir allegedly cheated one Deviante Djuran by making her believe that he could provide for food catering and equipment for her wedding on Feb 3, 2019 causing her to give him RM4,000 at 1pm on Aug 21, 2018 at a restaurant here.
The prosecution had called four witnesses to testify against the accused throughout the trial.
Counsel Sylyester Kuan, representing Nassir said they are expected to call two to three witnesses to testify in the defence.
The charge, under Section 420 of the Penal Code, provides for a jail term of between one and 10 years, and whipping and fine on conviction.
In another case, a 66-year-old driver was charged with two counts of disposing of stolen jewellery.
No plea was recorded Abdullah Yong Abdullah, who appeared before court registrar Rita Kunsoi.
On the first count, Abdullah was accused of disposing of three gold bracelets, two gold necklaces and a gold ring on Feb 27 at a goldsmith shop in the Centre Point Complex.
The second count stated that Abdullah allegedly disposing of one gold bracelet and one gold necklace at 11am on Feb 7 at the same place.
Each charge under Section 414 of the Penal Code carries a jail term of up to seven years or fine or both on conviction.
The prosecution proposed bail at RM4,000 in two sureties each.
Duty counsel Lim Ming Zoong @ Lawrence, representing Abdullah applied for a lower bail amount due to his age and works as a driver.
The court fixed March 28 for mention and released Abdullah on bail of RM1,500 in two sureties on each charge.
