
Kota Kinabalu: A 38-year-old fishmonger claimed trial at the High Court here, Monday, to trafficking 101.83gm of syabu.
Al Aznher Ahmad, who was brought before Judicial Commissioner Amelati Parnell, pleaded not guilty to the charge framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952.
Aznher was accused of committing the offence at 7.45pm on Jan 7, 2021 at the residential flat area, Kg Sembulan Tengah here.
The charge carries the death sentence or life imprisonment and whipping not less than 15 strokes if not sentenced to death, on conviction.
The court set April 28 for case management.
Deputy Public Prosecutor Azreen Yas Mohamad Ramli prosecuted while Aznher was represented by counsel Azhier Farhan.
Aznher was ordered to be remanded further as the charge framed against him has no provision for bail.
Meanwhile, at the Magistrate’s court, a 26-year-old woman charged with dishonestly misappropriating property, was given a discharge not amounting to an acquittal (DNAA).
The court made the order on Viona Beverllyne, whose case was scheduled for trial on Monday.
Earlier, Viona’s counsel Amli Nohin, applied for the case to be DNAA informing the court that there was no prosecution witness available for the trial as well as no presence of the investigating officer, which confirmed by the prosecution.
Amli submitted that it was not fair for Viona, who now works as a nurse in Perak, as it cost her time and money to come all the way from Perak, adding that she is scheduled to return to Perak on March 17.
Viona was accused of misappropriating RM4,487.70, which belonged to Syarikat Sahabat Jaya Enterprise, for her own use between Oct 19, 2019 and Dec 21, the same year at the said company at Jalan Tuaran Inanam.
The charge, under Section 403 of the Penal Code, carries a jail term of between six months and five years and whipping and liability of a fine on conviction.
