Selling illegal vape liquid: Man fined RM3,000

Kota Kinabalu: A man was fined RM3,000 or three months’ jail for having for sale 60 types of liquid for electronic cigarette (vape) containing poison without licence.

Sessions Court Judge Azreena Aziz handed down the sentence to Abdul Gafoor Hasanudeen after he pleaded guilty to the charge against him on Monday.

Abdul was found selling the liquids with various names and flavours at 3pm on Aug 20, 2019 at the Famous Electric Shop, Grace Square, Sembulan, here.

All the liquids containing poison which was nicotine and Abdul did not have license to sell the poison.

The offence under Section 13 (a) of the Poisons Act 1952 and punishable under Section 32(2) of the same Act provides for a fine of RM3,000 or a jail term of up to a year, or both, on conviction.

In another case, a company was fined a total of RM6,000 for having for sale hand sanitisers which were not registered under the Health Ministry and had no labels.

The court imposed the sentence on Chua Kah Seng (CKS) Supermarket Sdn Bhd after its representative admitted to two charges against the company.

On the first count, the company was ordered to pay RM3,000 in default seven days’ jail for having unregistered hand sanitisers at 11.20am on Sept 9, 2020 at CKS Manggatal Plaza in Manggatal.

On the second count, the company was fined RM3,000 or seven days’ jail for having three types of hand sanitisers without labels at the same place and time.
