
Kota Kinabalu: A 21-year-old man was fined RM3,000 or 12 months’ jail on Friday for cheating a woman of RM2,830 over a smartphone.
Md Ikmal Jamalin, whose case came up for trial before Magistrate Stephanie Sherron Abbie, changed his plea to guilty to the charge.
Ikmal pleaded guilty to deceiving Noor Fazirah Davy by deliberately encouraging her to hand over her iPhone 11 Pro 64GB by giving her a fake receipt in which he did not transfer RM2,830 into her account.
Ikmal had committed the offence on July 22, 2021 in a house at Kg Likas, Lorong Tabib, Jalan Haiwan.
The charge under Section 415 of the Penal Code punishable under Section 417 of the same Code carries a jail term of up to five years or fine, or both, on conviction.
The court ordered Ikmal’s bail to be refunded.
In another case, a woman was ordered to pay a fine of RM1,500 or six months’ jail for obstructing the police from discharging their duty.
Elvynah Masain pleaded guilty to committing the offence at 2.30am on March 8 this year at the Telipok Ria Phase 3.
The court heard from the prosecution that Elvynah, who was seated in the front passenger seat of the car, which sped off to avoid being screened by the police, acted aggressively and refused to give cooperation when the police wanted to investigate.
Investigation revealed that the woman, later identified as Elvynah, who was then arrested, was drunk after a drinking session in Penampang and claimed that she did not remember the incident, in which a man, entered her car and drove it with her still inside.
Elvynah was charged under Section 186 of the Penal Code which carries a jail term of up to two years or fine of up to RM10,000, or both, on conviction.
