
Kota Kinabalu: Panel speaker Chan Leng Sun, Senior Counsel and Chartered Arbitrator of Singapore’s Duxton Hill Chambers, said since the 1878 Treaty has no arbitration clause: “Dr (Gonzalo) Stampa has no legal standing as an arbitrator.”
He said this during a Zoom dialogue at the Session 2 of the International Arbitration Colloquium 2023 event held at the Sabah International Convention Centre on Tuesday July 4, entitled – “The Sulu Case: Time to Preserve Sovereign Immunity?” which was moderated by Sabah Law Society President Roger Chin Ken Fong.
To him, what happened was an abuse of the international arbitration process with its enforceability under the New York Convention. Any award by Dr Stampa can be set aside as it breaches natural justice besides other considerations, including by a ruling of a court of competence in the country affected.
