
Kepong Member of Parliament (MP) Lim Lip Eng has expressed grave concern over the recent discharge not amounting to acquittal (DNAA) granted to former Prime Minister Datuk Seri Najib Razak and former Treasury Secretary-General Tan Sri Mohd Irwan Serigar Abdullah. The two were involved in a high-profile case related to the alleged misappropriation of RM6.6 billion in government funds, which were supposedly transferred to the International Petroleum Investment Company (IPIC).
In a court session on November 27, the Kuala Lumpur High Court ruled that the prosecution had failed to meet the necessary legal requirements under Section 51A of the Criminal Procedure Code (CPC), which mandates the disclosure of evidence to the defense. This failure led to the DNAA, leaving both Najib and Irwan free of charges for now, though they remain under suspicion in this major criminal breach of trust (CBT) case that has been ongoing since 2018.
Lim, who is also a member of the opposition DAP party, voiced his deep concerns about the ruling, emphasizing the significance of the case to both public funds and national trust. In a statement, Lim stressed that this case, involving large sums of taxpayer money, had captured widespread attention and must not be allowed to falter due to procedural oversights.
He called on the Attorney General's Chambers (AGC) to take immediate action by reviewing the case and pursuing a re-prosecution if there is sufficient evidence. “The AGC must thoroughly review the case and proceed with the prosecution if the evidence warrants it,” Lim stated, underscoring the importance of swift and decisive action in maintaining the integrity of the judicial process.
The DAP lawmaker, who is also a practicing lawyer, pointed out that the failure of the prosecution to meet legal requirements was not a trivial matter and could undermine the credibility of the entire legal system. He insisted that the AGC should ensure all necessary documents and evidence are fully prepared and submitted to avoid further delays or technical issues.
“The case must be conducted in a fair, open, and transparent manner. All documents crucial for the prosecution must be complete, properly submitted, and handled with the utmost care,” Lim emphasized. He highlighted that this case is a critical test of the nation’s commitment to justice, the rule of law, and accountability, stressing the need for prompt action to restore public faith in the country's legal institutions.
Lim also warned that any further delay or mishandling of the case could deepen public skepticism regarding the justice system, especially given the high-profile nature of the individuals involved. “The people are watching, and the integrity of our judicial institutions is at stake. This is not just about two individuals, but about the public's trust in our legal framework,” he concluded.
The call for a re-trial comes at a time when political and public scrutiny of Malaysia's judiciary is at a peak, especially in cases involving prominent figures from the previous administration. With mounting pressure from both the public and the opposition, Lim’s statement underscores the importance of transparency and accountability in ensuring justice is served, regardless of the political or financial stature of those involved.
