Cannabis: Self-employed ordered to enter defence

Kota Kinabalu: A self-employed man who was charged with trafficking 477gm of cannabis was ordered to enter his defence.

High Court Judicial Commissioner Amelati Parnell made the order against Mohd Sahril Saharuddin, 29.

Amelati ruled that the prosecution had established a prima facie case against Shahril. The court fixed Oct 24 for Sahril’s defence.

Sahril was accused of committing the offence at 8.40am on July 21, 2021 in front of the Nationwide Express Courier Services Bhd at HS Commercial Centre in Penampang.

Read more The charge under Section 39B(1)(a) of the Dangerous Drugs Act carries the death sentence or imprisonment for life and whipping not less than 15 strokes if not sentenced to death, on conviction.

The prosecution had called six witnesses during the prosecution’s stage. Deputy Public Prosecutor Rustam Sanip prosecuted while Sahril was represented by counsel PJ Perira.

Pending the continuation of the trial date, Sahril was ordered to be remanded further as the charge against him has no provision for bail.

In another case, an undocumented man was jailed 13 months for hiding a stolen motorcycle.

Marjin Jinur pleaded guilty before Magistrate Lovely Natasha Charles to disposing of the stolen Modenas Kriss motorcycle belonging to Aniza Maszian at the parking area at University Condo Apartment 2, Kg Dambai, Manggatal at 1.30pm on Aug 16.

He was charged under Section 414 of the Penal Code which carries a jail term of up to seven years or fine, on conviction.

The court was informed by the prosecution that Marjin led the police to the recovery of the stolen machine.

Unrepresented, Marjin requested leniency and confessed to having no identification documents.

Inspector Kelvan Elson Maik prosecuted applied for a deterrent sentence and also for Marjin to be referred to the Immigration Department after serving sentence, which was then granted by the court. Marjin was ordered to serve the sentence from the date of his arrest.

Meanwhile, Marjin also faces another charge of taking drugs.

However, no plea was recorded from him pending the chemist’s report. Lovely set Oct 16 for e-review.
