
The Chandigarh bench of the Central Administrative Tribunal has directed Chandigarh Administration to complete the process of finalisation of Recruitment Rules and notification for the post of Planning Officer in Department of Urban Planning of Administration within a period of three months.
The bench has passed the order on an application filed by Harish Chander, Selection Grade Planning Draftsman in the department through advocate Rohit Seth.
In the application the applicant sought direction to Chandigarh Administration to finalise and notify the recruitment rules for promotional post of Planning Officer in Department of Urban Planning pursuant to notification dated March 29, 2022.
He also prayed that respondents may be directed to consider his claim for regular promotion to the post of Planning Officer from due date, being senior most eligible employee in feeder cadre, in terms of notified Recruitment Rules Secretary Urban Planning, UT Chandigarh in the reply said that the applicant had joined service as Junior Draftsman on May 11, 2000 and was promoted as Planning Draftsman on May 16, 2012 and further promoted as Senior Planning Draftsman on June 23, 2017.
He was lastly promoted as Selection Grade Planning Draftsman on July 11, 2023 under the existing Rules, 2001 which are still operative and binding for all.
As per the existing rules of 2001, the applicant would be eligible for next promotion as Planning Officer in 2028. Thus, the claim of the applicant is totally premature. It has also been contended that draft rules are yet to be notified, and no enforceable right of the applicant has been infringed.
After hearing of the arguments the bench has disposed of the application with direction to respondents to complete the process of finalisation of Recruitment Rules and notification. within a period of three months.
