Kota Kinabalu: A 44-year-old woman was fined a total of RM5,500 over pharmacy-related offences.
Azizah Matusop pleaded guilty before Noor Hafizah Mohd Salim to three charges against her.
On the first count, Azizah was fined RM2,000 or 30 days’ jail for having for sale nine types of products without licence at 12.45pm on Jan 30, 2020 at the Perniagaan Amira in Bongawan Plaza, Phase 2, Pekan Bongawan in Papar.
The charge stated that among the poison detected in the products were Yohimbine, Tadalafil and Sildenafil which are listed in the First Schedule of the Poisons Act 1952.
The offence, under Section 13(a) of the Poisons Act and punishable under Section 32(2) of the same Act, carries a fine of up to RM3,000 or a jail term of up to a year, or both, on conviction.
On the second count, she was ordered to pay a fine of RM2,000 or 30 days’ jail for having 29 types of unregistered products at the same place and time.
Among the products were Tolak Angin, Safe Care Minyak Angin Strong, Safe Care Refreshing Oil, Clobetamil G, Lorenxo, Freshcare Greentea, Freshcare Teens Happy Cherry, Freshcare Teens Buble Gum, Freshcare Sports, Freshcare Sandalwood, Candy B+ Complex, Mocha B+ Plus and Titan Gel.
On the third count, Azizah was fined another RM1,500 or 30 days’ jail for having three types of cosmetic without notification at the same place and time.
The three cosmetics were 21 boxes of Collagen Plus Vit E Day, 21 boxes of Collagen Plus Vit E Night Cream and two unit Galong Herbal Thailand Lightening.
During mitigation, Azizah, who was not represented, asked for leniency saying that she has children to look after and that her business was not good. She promised that she would not repeat the offence.
However, Prosecuting Officer Mad Sapri Tumiran from the Pharmacy Department urged the court to impose an appropriate sentence to Azizah.
