Kota Kinabalu: The Election Court on Wednesday struck out Parti Kesejahteraan Demokratik Masyarakat (KDM) president Datuk Peter Anthony’s petition to nullify the result for the Tenom parliamentary seat in the 15th General Election which favoured an independent candidate.

High Court Judge Dean Wayne Daly allowed the notice of application by the independent candidate, Riduan Rubin (first respondent) and a preliminary objection raised by Tenom general election returning officer Mas Syazwan Masood, Election Commission chairman Tan Sri Ghani Salleh and the Election Commission, who were the second, third and fourth respondents respectively, to strike out the election petition filed against them.

Dean ordered RM20,000 cost to be awarded to the first respondent and RM20,000 to the second, third and fourth respondents.

Riduan won the five-cornered fight for Tenom after polling 10,027 votes.
