Criminal Breach of Trust: Trader claims trial

Kota Kinabalu:  A 55-year-old businessman claimed trial to three counts of committing criminal breach of trust involving a sum of RM140,000.

Chee Chi Seng made the plea after the charges were read before Sessions Court Judge Elsie Primus, Friday.

On the first count, Chee is accused of breaching the trust given to him by misusing the cheque book for Public Bank Berhad under Syarikat Borasmas Sdn Bhd – RM50,000 for his personal use.

The offence allegedly took place at 4.43pm on Dec 27, 2024 in Jalan Centre Point City Parade, here.

On the second count, he allegedly committed criminal breach of trust by making use of RM60,000 inside the bank for his own use at 3.47pm on Dec 31, 2024 at the same place.

On the third count, Chee is accused of committing the offence by misusing RM30,000 inside the same account bank on Jan 6 this year at 4.58pm at the same place.

The offence, under Section 406 of the Penal Code, carries a jail term of up to 10 years, and whipping, and liable to fine, on conviction.

The court set Nov 28 this year and released Chee on bail of RM10,000 in two local sureties for each charge.

Chee was also ordered to report to the nearest police station every month and his passport, if any, to be impounded by the court until the disposal of his case.

Deputy Public Prosecutor Muhd Yousof Tahir Mahmood appeared for the prosecution while counsel Zahir Shah defended Chee.
