Clare Rewcastle-Brown, the esteemed founder and editor of Sarawak Report, has taken a significant step in her legal battle against the recent verdict handed down by the Kuala Terengganu Magistrate’s Court. This verdict, which sentenced her to a two-year prison term for defamation against Sultanah Nur Zahirah of Terengganu, has prompted Rewcastle-Brown to file an appeal.

In a bid to challenge both the conviction and the associated sentence, Rewcastle-Brown has initiated the appellate process by submitting a notice of appeal at the Kuala Terengganu High Court. Her appeal seeks to overturn the ruling and secure a fair reconsideration of the case.

In her appeal, Rewcastle-Brown has urged the court to review the sentence in light of various legal provisions, including Sections 323 to 327 of the Criminal Procedure Code and Sections 31 and 35 of the Courts of Judicature Act 1964. Additionally, she has requested not to be present during the appeal hearing, a detail confirmed by her lawyer, Guok Ngek Seong.

The recent judgment, delivered by Magistrate Nik Mohd Tarmizie Nik Mohd Shukri, found Rewcastle-Brown guilty of defamation against Sultanah Nur Zahirah. The basis of the conviction rested on allegations made in her book, "The Sarawak Report - The Inside Story of 1MDB Expose," published with a London address. The book contained statements deemed derogatory towards the Sultanah, particularly referring to her as "the wife of the Sultan," a phrase construed as defamatory and aimed at tarnishing her reputation.

The offence was purported to have taken place on September 14, 2018, at Lot 60048, Taman Chendering Utama. Rewcastle-Brown was formally charged under Section 500 of the Penal Code, which stipulates a penalty of up to two years in prison, a fine, or both upon conviction.

As legal proceedings unfold, Rewcastle-Brown remains steadfast in her pursuit of justice, emphasizing the importance of upholding principles of freedom of expression and ensuring fair judicial processes in cases of this nature.
