Disposing stolen jewellery: Man gets fine and jail

Kota Kinabalu: A man was jailed 11 months and fined RM8,000, or nine months in jail by the Magistrate’s Court, here, Monday for disposing of stolen jewellery two years ago.

Jamil Md Andang pleaded guilty before Magistrate Marilyn Kelvin to assisting in the disposal of stolen property, namely a gold chain and a gold ring belonging to Chin Kuin Yin, at a gold shop in Kepayan between 2pm and 5pm on May 18, 2023.

Jamil had committed an offence punishable under Section 414 of the Penal Code, read together with Section 34 of the same Code, which carries a jail term of up to seven years or a fine or both, on conviction.

The facts of the case presented by the prosecution stated that on May 18,  2023, at 3.10pm, a complainant discovered that their house at Kobusak Vila, Jalan Kobusak, Penampang had been broken into by unknown suspects who forced their way in through the back.

The complainant suffered about RM45,000 in losses.

A police report was lodged and several suspects were later arrested.

Investigations revealed that two suspects were directly involved in the break-in, based on identification and information provided by an accomplice.

Jamil was found guilty of selling the stolen items.

The court ordered Jamil’s prison term to take effect from Monday.

In another case, a 24-year-old woman was fined RM1,400 or one month’s jail for engaging in illegal online gambling activity.

Nurul Ain admitted to committing the offence in a public place at Lorong Grace Square 1, Jalan Pantai Sembulan at 4.41pm on Sept 10, this year.

The charge, under Section 7(2) of the Common Gaming Houses Act 1953, provides for a fine of up to RM5,000, or up to six months’ imprisonment, or both, on conviction.

According to the facts, on the said day, a police team raided the laundry premises and detained Nurul, seizing gambling-related items used for online betting activities.

Nurul admitted to engaging in online gambling, while an expert report confirmed that the seized devices were used for such activities.

The court ordered the seized RM247 to be forfeited to the government.

Meanwhile, a 41-year-old Filipino was charged with voluntarily causing hurt using a dangerous weapon.

Raj Sapari, who has no identification documents, pleaded not guilty to injuring one Matt Shazeeley Mohd Salleh with a pair of scissors at 3.39am on Sept 9, this year, at a house in Taman Suria Kepayan, Kobusak, near here.

The charge, under Section 324 of the Penal Code, carries a jail term of up to 10 years, or a fine, or whipping, or any two of the punishments, on conviction.

The court fixed Nov 13 for pre-trial case management and ordered the accused to be further remanded.
