
SANDAKAN: The Magistrate’s Court here on Monday jailed a local man to 12 months for having 0.03gm of syabu.
Magistrate Yong Ching Hong handed down the sentence after the prosecution succeeded in proving its case against Husaini Othman, 52, at the end of a full trial.
Yong ordered Husaini to serve the sentence with effect from Sept 12, 2024.
Husaini had committed the offence at 11.30pm, on June 22, last year during an Ops Tapis operation in Kampung Bokara, Jalan Panglima Adam, Sandakan, conducted by a team from the district police narcotics division.
During the raid, Husaini, who was found seated inside a room of a house in the village, was suspected of drug abuse.
A room search led to the discovery of a small transparent plastic packet containing crystalline lumps believed to be methamphetamine (syabu), along with a piece of folded aluminium foil and a foil wrapper.
The exhibits were sent to the Chemistry Department for analysis and confirmed to contain 0.03g of methamphetamine.
Husaini was convicted under Section 12(2) of the Dangerous Drugs Act 1952, punishable under Section 12(3) of the same Act, which carries a fine of up to RM100,000 or a maximum five years’ jail, or both.
Prosecuting Officer Inspector Nooraznie Bolalan appeared for the prosecution.
Five witnesses were called by the prosecution while the defence produced four.
