
Kota Kinabalu: The Magistrate’s Court here, Tuesday, sentenced a 32-year-old man to one day-jail and fined him RM10,000 or three months’ jail for drink-driving.
Bartender Lance Daniel pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence at 12.40am on Aug 25, 2022 at Jalan Pintas Kopungit here.
Lance was charged under Section 45A(1) of the Road Transport (Amendment) Act 2020, which provides for a jail term of up to two years and fined between RM10,000 and RM30,000 and lost qualification from holding or getting a driving licence for not less than two years from the date of conviction.
The court also ordered Lance’s driving licence to be suspended for two years.
Earlier, traffic prosecuting officer Mohammad Khairul Nizam Mokhtar told the court that Lance, who drove a Perodua MyVi, was found committing the offence during the Ops Mabuk conducted along the said road.
Counsel Lim Ming Zoong @ Lawrence representing Lance, applied for a lower fine as he had been cooperative to the police during the roadblock and he has many dependants.
Meanwhile, a 31-year-old woman was fined RM1,000 or one-month jail for engaging in online gambling activity.
Calesta Ginduoh admitted to online gambling with a handphone at 3.15pm on Feb 15, this year at a premises at Beverly Hills Plaza, Jalan Bundusan, Penampang.
Inspector Suzie @ Stephanie Kupit, prosecuting, told the court that Calesta was arrested by police during Ops Dadu for conducting the activity and seized a handphone and RM105 cash from her.
Calesta was charged under Section 7(2) of the Common Gaming House Act which provides for a fine of up to RM5,000 or up to six month’s jail, or both, on conviction.
