Duo charged with causing two road deaths

Kota Kinabalu: Two men were separately charged at the Traffic Court here Thursday with dangerous driving which caused the death of motorists in Penampang, two years ago.

Mathew Mujim @ Ity, 61, and Chow Tet Pink, 29, who appeared before Magistrate Stephanie Sherron Abbie, pleaded not guilty to the charge against them, respectively.

Mathew was accused of driving a Toyota Innova car in a dangerous manner and causing the death of a motorcyclist one Muhammad Hazwan Nur Alip, 22, at 9.45am on Oct 27, 2021 at Jalan Kota Kinabalu–Papar, near the Rustica U-turn.

Chow allegedly drove an Isuzu D-Max in a dangerous manner and caused the death of a car driver one Zursidin Nordin at 5pm on Nov 5, 2021 at Jalan Papar Lama near Kg Ramayah.

The offence, under Section 41(1) of the Road Transport Act, carries a jail term of between five years and 10 years and a fine of between RM20,000 and RM50,000 if convicted.

The court fixed March 23 for Mathew’s pre-trial case management (PTCM) and released him on a bail of RM2,000 in one surety.

Chow was offered bail at RM2,000 in one surety pending PTCM also on March 23. Traffic Prosecuting Officer Inspector Mohd Firdaus Che Mustafa prosecuted.

Meanwhile, three people were penalised for taking syabu.

Jaslin Saludin, Mohammad Affendy and Siti Rasida Juni pleaded guilty separately before Magistrate Jessica Ombou Kakayun to committing the offence at different locations here on December last year.

Jaslin and Mohammad were sentenced to nine months in jail each from the date of their arrest.

Siti was ordered to pay a fine of RM2,000 or nine months in jail on conviction.

Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years in jail on conviction.
