Drugs: Duo ordered to enter defence

Kota Kinabalu: Two young accused were ordered to enter their defence on a charge of trafficking in 1,046.6gm of syabu.

High Court Judge Leonard Shim made the order against Jamal Tampakan, 22, and his 17-year-old co-accused, after ruling that the prosecution had established a prima facie case.

The court set April 6 for their defence.

The duo allegedly committed the offence in front of a bank at Jalan Sagunting at 10.30pm on July 2, 2019.

The offence under Section 39B (1) (a) of the Dangerous Drugs Act 1952, read together with Section 34 of the Penal Code.

The duo are liable to the death sentence or an imprisonment for life and if not sentenced to death be punished with whipping, upon conviction.

The prosecution had called five witnesses during the hearing.

Deputy Public Prosecutor (DPP) Nur Faezah Jafry conducted the prosecution while counsel Edward Paul for Jamal and counsel Benazir Japiril for the other accused.

In another case, three person were freed from a charge of having 33.44gm of syabu, without their defence being called.

Sessions Court Judge Elsie Primus discharged and acquitted Nirma Hajari, Jubinar Jul and Arnisar after ruling that the prosecution failed to establish a prima facie case.

The trio were accused of having the drugs at 5.10am on June 8, 2020 at a house in Inanam.

DPP Mas Izzaty Lokman conducted the prosecution while counsel Dominic Chew for the trio.
