Kota Kinabalu: A 63-year-old man was ordered to enter his defence for committing physical sexual harassment against a 13-year-old girl.
Sessions Court Judge Azreena Aziz made the order against Jonbi Suilin after ruling that the prosecution had established a prima facie case.
The court set March 21 for Jonbi’s defence.
He is accused of committing the offence against the girl at 7.30pm on July 20, 2019 at a car park near the Dato Syahbandar Mekang Hall in Kuala Penyu.
The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 carries a jail term of up to 20 years, and whipping, upon conviction.
The prosecution had called six witnesses during the hearing.
Counsel Amli Nohin defended Jonbi.
Meanwhile, the trial of a 30-year-old man charged with causing grievous hurt to his sister, had been re-scheduled to July 21 and 28 this year.
The date of trial was re-scheduled as the court has to proceed with two cases in year 2021 and one of it was for continuation of trial.
The date was given to Mohamad Firdaus Arbi.
Firdaus is accused of causing grievous hurt to Jumat Arbi, 51, with a knife at 6.30pm on March 8, 2022 at a house in Kg Pasir Putih, Putatan.
The offence under Section 326 of the Penal Code carries a jail term of up to 20 years, and liable to a fine and whipping, on conviction.
Pending the date, Firdaus was further remanded.
Deputy Public Prosecutor Tham Pou Jin appeared for the prosecution while Firdaus was not represented.
