Molesting daughter, 20: Man, 63, charged

Kota Kinabalu: A 63-year-old man was charged at the Magistrate’s Court here Monday with two counts of molesting his 20-year-old daughter.

The self-employed man, who was brought before Magistrates Lovely Natasha Charles and Stephanie Sherron Abbie pleaded not guilty to both charges.

On the first count before Lovely, the man was accused of committing the offence against his daughter in a hotel room at Tanjung Aru at 9pm on Jan 29, this year.

On the second count before Stephanie, the accused allegedly molested his daughter at the same place at 9pm on Jan 30.

Each charge under Section 354 of the Penal Code provides for a jail term of up to 10 years, or with fine or with whipping or with any two of such punishments, on conviction.

The prosecution in applying for another mention date proposed bail at RM5,000.

The Magistrate fixed March 6 for case management.

On the first count, the man was offered bail at RM3,000 in two sureties while on the second count he was released on a bail of RM2,500 in two sureties.

In another case, two unemployed men were charged with two counts of having stolen cable and housebreaking tools.

An IMM13 holder Iskandar Jakaria, 31, and another accused were accused of having 73 pieces of cable of various sizes belonging to Telekom Malaysia Berhad at 4.15pm on Jan 23, this year at a car park in front of Maya Condominium, Mile 2, here.

The duo also allegedly had housebreaking tools comprising a hacksaw, two crowbars and a cable cutter.

The first count is framed under Section 411 of the Penal Code while the second count under Section 18(e) of the Minor Offences Ordinance.

Iskandar claimed trial.

The second accused pleaded guilty to both charges and told the court that he is 18 years old but according to his mother, he is 14 years old, to which the court ordered for him to be referred to a dental clinic to determine his actual age.

The court set March 21 for Iskandar’s case management and the second accused’s mention date pending the outcome of the dental examination.

Both accused are to be further remanded pending the date.
