Kota Kinabalu: A former ship captain was on Wednesday jailed 18 months by the Sessions Court for selling 7,000 litres of diesel worth RM42,000 belonging to an oil and gas company to others.

Jasmun Suhur, 60, pleaded guilty before Judge Noor Hafizah Mohd Salim to committing a breach of trust while being the captain who was entrusted with 7,000 litres of diesel belonging to Petroleum Nasional Berhad (Petronas) on board Express 71 at ERB West between 11.22pm on April 21, 2023 and 1.18am on April 22, the same year.

The charge under Section 408 of the Penal Code carries a jail term of between one year and 14 years and whipping and liability of a fine, on conviction.

Noor Hafizah ordered Jasmun to serve the sentence from the date of his arrest on Jan 9.

Earlier, the prosecution informed the court that police received information and a complaint from Petronas Upstream Logistics on the misappropriation of diesel owned by Petronas.

Investigations revealed that Express 71 was rented by a company appointed as a sub-contractor by another company that was given a project to transport platform workers.

For the refuelling for the project, diesel would be given free of charge to the ships involved in the project and Express 71 received diesel for free from Petronas.

Jasmun was appointed the ship’s captain by the said company.

Further investigations revealed that the crew confirmed that Jasmun sold the fuel to others.

The crew saw Jasmun receiving payment every time a foreigner bought the fuel and transferred the diesel from Express 71 to another ship.

Unrepresented, Jasmun begged for a lenient sentence by admitting his mistake and that it was his first offence.

Jasmun added that he has eight children who are still in school and need to pay other expenses.

Deputy Public Prosecutor DK Afiqah Alya PG Johari prosecuting, applied for a heavier sentence that would serve as a deterrent.
