
Kota Kinabalu: The Sessions Court here fixed Oct 27 for further mention of a case involving a 46-year-old man charged with raping his eight-year-old daughter.
The date was fixed after the prosecution tendered a psychiatric evaluation report from Hospital Mesra Bukit Padang confirming the accused is fit to stand trial.
He is alleged to have committed the offence against the girl at 7pm on Nov 22, 2024, at a house in Sembulan.
The charge under Section 376(3) of the Penal Code provides for a jail term of between eight and 30 years, and at least 10 strokes of the cane, upon conviction.
Deputy Public Prosecutor Bryan Francis informed the court that seven witnesses will be called during the trial, while the unrepresented accused was ordered remanded further.
